THE EQUAL REMUNERATION RULES 1976

G.S.R. 119(E), New Delhi, the 11th. March, 1976. – In exercise of the powers conferred by Section 13 of the Equal Remuneration Act, 1976 (25 of 1976) and the Supersession of Equal Remuneration Rules, 1975, the Central Government hereby makes the following rules, namely: -

CHAPTER I Preliminary

1. Short title, and commencement. -- (1) These rules may be called the Equal Remuneration Rules, 1976.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. -- In these rules, unless the context otherwise requires: -

(a) “Act” means the Equal Remuneration Act, 1976 (25 of 1976);

(b) “Authority” means an authority appointed by the appropriate Government under sub-section (1) of Section 7;

(c) “Form” means a form appended to these rules;

(d) “section” means a section of the Act;

(e) “registered Trade Union” means a Trade Union registered under the Trade Unions Act, 1926 (16 of 1926).


CHAPTER II

Complaints and Claims under the Act

3. Complaints regarding contravention of the Act. -- (1) Every complaint under clause (a) of sub-section (1) of Section 7 shall be made in triplicate, in Form ‘A’ to the Authority.

(2) A single complaint may be made by, or on behalf of, or in relation to, a group of workers, if they are employed in the same establishment and the complaint relates to the same contravention.

(3) A complaint may be made by the workers himself or herself or by any legal practitioner, or by any official of a registered Trade Union, authorized in writing to appear and act on his or her behalf or by any Inspector appointed under Section 9 or by any other person acting with the permission of the Authority. 

4. Claim regarding non-payment of wages etc. -- (1) Every claim under clause (b) of sub-section (1) of Section 7 shall be made y petition in triplicate, in Form ‘B’ to the Authority.

(2) A single petition may be made by, or on behalf of, or in relation to, a group of workers, if they are employed in the same establishment and their claims are of the same nature.

(3) A claim may be made by the worker himself or herself or by any legal practitioner, or by any official or a registered Trade Union, authorized in writing to appeal and act on his or her behalf or by any Inspector appointed under Section 9 or any other person acting with the permission of the Authority.

5. Authorization. -- The authorization referred to in Sub-rule (3) of Rule 3 or Sub-rule (3) of Rule 4 shall be in Form ‘C’ which shall be presented to the Authority to whom the complaint or the claim as the case may be, is made along with such complaint or claim and shall form part of the record.

CHAPTER III

Registers to be Maintained

6. Registers to be maintained by the employer. -- Every employer shall maintain a register in relation to the workers employed by him in Form ‘D’.

Exemption From Payment Of Late Fee Under Maharashtra Professional Tax 

As per Trade Circular 15T dated 19th October 2018, the Office of the Commissioner of Professional Tax has clarified that the whole late fee payable by the registered employer in respect of monthly or annual returns pertaining to periods April 2016 to November 2018 is exempted subject to fulfillment of eligibility conditions mentioned, viz. : 

(1) Any amount payable as per return should have been/shall be on or before the due date.;

(2) The aforesaid employers should submit the monthly or, as the case may be, annual returns pertaining to the periods April 2016 to November 2018 on or before 31st December 2018. The Office of Commissioner has further clarified that no refund or adjustment against any tax liability shall be allowed where late fee has already been paid

The Government of Goa is pleased to direct that the days specified in the Annexure–I shall be observed as Public Holidays and the days specified in the Annexure–II as Special Holidays in all Government Offices in the State of Goa during the year 2019 (Saka 1940-1941). All Government Offices will be functional on Special Holidays except if the Special Holidays occur on Saturday or Sunday. 
2. In addition to the Holidays specified in Annexure–I and Annexure–II, employees are permitted to avail of any two holidays from the list of Restricted Holidays specified in Annexure–III for the year 2019
3. The Government is also pleased to declare Commercial and Industrial Holidays for the Commercial and Industrial Workers in Goa as specified in Annexure–IV for the year 2019.
4. Further, in exercise of the powers conferred under explanation to Section 25 of the Negotiable Instruments Act, 1881 (Act 26 of 1881) read with Government of India, Ministry of Home Affairs, New Delhi, vide Notification No. U.11030/2/73-UTL dated 28-6-1973, the Government of Goa is also pleased to declare the days specified in Annexure–V as Bank Holidays in the State of Goa for the year 2019.

According to the decision communicated by Government of India, Ministry of Finance in Memorandum No. F. 8 (7) EST (SPI) dated 7th November, 1963 casual employees including daily rated staff will be entitled to paid holidays if they are in service on the preceding and succeeding working days.
