1. Statutory Background

  • The advisory is issued pursuant to the order of the Commission for Air Quality Management (CAQM) invoking Stage-IV of the Graded Response Action Plan (GRAP) across Delhi & NCR.

  • Under Stage-IV GRAP, State Governments / GNCTD are empowered to regulate office attendance to curb vehicular and human movement.

2. Direction to Private Establishments

  • All private institutions and corporate offices in Gurugram District are advised to:

    • Ensure not less than 50% of employees work from home (WFH).

    • The remaining workforce may attend office, subject to operational necessity.

3. Effective Date & Validity

  • Effective from: 22 December 2025

  • Duration: Until further orders are issued by the competent authority.

4. Nature of the Advisory

  • Though termed an “advisory,” it flows from a CAQM order under GRAP Stage-IV, which carries regulatory force.

  • Non-compliance may attract scrutiny under:

    • Environmental protection directions, and

    • District administration enforcement powers during GRAP implementation.

5. Practical Compliance Guidance for Employers

  • Issue an internal circular / SOP documenting:

    • 50% WFH roster or rotational attendance,

    • Identification of essential on-site roles.

  • Maintain attendance and WFH records for inspection, if required.

  • Align transport, canteen, and shift policies with reduced physical attendance.

  • No change is mandated to wages, continuity of service, or statutory benefits merely due to WFH.

6. Applicability Clarification

  • Applies to private institutions and corporate offices in Gurugram District.

  • Public, municipal, and other establishments remain subject to separate Government decisions under GRAP.
