🏭 Maharashtra Factories (Second Amendment) Rules, 2025 – Key Highlights

🔹 Major Amendments

1. Digitisation of Procedures

  • All references to “made in Form” are replaced with “made electronically in Form”.

  • Duplication and triplicate submission requirements are removed.

  • Submission of forms (Forms 1, 4, 6A, 7A) to be done electronically through the DISH portal.

  • Use of Digital Signature recognised under the Information Technology Act, 2000.


2. Schedules Updated

🔸 Schedule A – Applicable to All Factories (except power generating stations)

Defines license fees based on:

  • Installed Horse Power (H.P.)

  • Number of workers employed

🔸 Schedule B – Applicable to Power Generating Stations

Defines license fees based on:

  • Power generation capacity (in Megawatts)

  • Number of workers employed

3. Medical Examination (Rule 18-A)

  • Every worker aged 45 years and above to undergo an annual medical examination free of cost.

  • Conducted by qualified medical practitioner/certifying surgeon/ESIC medical officer.

  • Health report to be maintained in Form 7-A (Health Register) and submitted electronically to the Chief Inspector within 15 days.


4. Mock Drill (Rule 73-ZD)

  • Every factory must conduct a mock drill once in six months.

  • Report and scenario to be submitted to the Inspector within 15 days of conducting the drill.


5. Employment of Women (Rule 102-B & 114-A)

📍 Women Working Between 7 PM to 6 AM

Employers must ensure:

  • Adequate transportation, security, and CCTV coverage for at least 45 days.

  • Minimum two women workers on duty at all times.

  • Written consent of women workers to be taken and retained for 3 years.

  • Facilities like toilets, restrooms, washing areas, drinking water, etc., must be well-lit and secured.

📍 Safety for Women in Hazardous Operations (Rule 114-A)

  • Women to be given personal protective gear (masks, aprons, overcoats, etc.).

  • Information on risks to be provided in Marathi and a language understood by workers.

  • Pregnant or lactating women prohibited from working with carcinogenic/teratogenic substances.

  • Women to receive proper training on hazards and safe handling.


6. Replacement of the word “Women”

In various Schedules (II, III, IV, VI, VII, VIII, X, XIV, XV, XVIII, XX, XXI, XXII, XXVI)
👉 The term “women” is replaced with “pregnant women, lactating mothers” — to ensure enhanced protection for these categories.


7. Rule 79 and Rule 102-C Deleted

Certain redundant provisions removed to simplify compliance.


8. Forms Revised

  • Form 1 – Application for new factory registration, amendment, or renewal (now electronic).

  • Form 4 – License to work a factory (now electronic, includes digital signature).

  • Form 7-A – Health Register for medical examination (digitised).

  • Form 5 – Deleted.


9. Additional Safety Provisions for Women (New Clause 6–8 under Rule 114-A)

  • Women to be provided escape training, protective equipment, and safe work environments.

  • Factories must prevent exposure to substances that may affect menstrual or reproductive health.


10. Effective Year

All references updated from 2013 → 2026, indicating renewed validity and implementation timelines.

  • Promote Ease of Doing Business (EoDB) through full digitisation.

  • Strengthen worker health and safety protocols.

  • Enhance gender-sensitive provisions for women and pregnant workers.

  • Improve industrial compliance monitoring via electronic submissions.
