What to do When Accident takes place in a Factory ?


If an accident takes place in a factory, which results in either death of a person or results in bodily injury, as a result of which the injured person is prevented from work for 48 hours or more is a ‘reportable accident' within the meaning of section 88 of the Factories Act, 1948 and should be reported as per provisions of the State Factories Rules framed under this section.

The procedure for reporting of accidents, as per provisions of State rule is as given below –:

Rules 96 - The Delhi Factories Rules, 1950 

(a) If an accident has resulted in the death of a person or which has resulted in such a bodily injury, which is likely to cause death-

(i) It should be reported henceforth with to the Inspector of Factories and the Chief Inspector of Factories by telephone, telegraph or special messenger.
(ii) Notices should also be sent to –

(a) District Magistrate or Sub-Divisional Officer
(b) Officer in charge of the nearest Police Station &
(c) Relatives of the deceased or injured worker.

(iii) Thereafter, it should be confirmed by delivering a written report in Form No. 18 to the Inspector of Factories and to the Chief Inspector of Factories, within 12 hours.

(b) If an accident has resulted in an injury as a result of which the injured person is prevented from work for 48 hours or more, it should be reported to the Inspector of Factories, within 24 hours after expiry of period of 48 hours from the time of accident in Form No.18.

SCHEDULE

The following classes of dangerous occurrence, whether or not they are attended by personal injury disablement :- 
(a) Bursting of a plant used far containing or supplying steam under pressure greater than atmospheric pressure.
(b) Collapse or failure of a crane, derrick, which hoist or other appliances used in raising or lowering persons or goods, or any part thereof, or the overturning of a crane.
(c) Explosion. fire, bursting out, leakage or escape of any molten metal, or hot liquor or gas causing bodily injury to any person or damage to any room or place in which persons are employed, or fire in rooms of cotton pressing factories when a cotton opener is in use.
(d) Explosion of a receiver or container used for the storage at a pressure greater than atmospheric pressure of any gas or gases (including air) or any liquid or. solid resulting from the compression of gas.
(e) Collapse or subsidence of any floor, gallery, roof, bridge, tunnel, chimney, wall, building or any other structure.
