The Plastic Waste Management Rules 2016




1. What is the Compostable plastics

As per PWM Rules “compostable plastics” mean plastic that undergoes degradation by biological processes during composting to yield CO2, water, inorganic compounds and biomass at a rate consistent with other known compostable materials, excluding conventional petro-based plastics, and does not leave visible, distinguishable or toxic residue;

2. What is difference between Compostable and Biodegradable plastics? 
Biodegradable items refer to any material which breaks down when exposed to the presence of microorganisms and decomposes in the environment, whereas compostable goods are specifically organic matter which breaks down, the end product having many beneficial uses which include fertilizing and improving soil health. Biodegradable plastics are not compostable plastics.

3. Which manufacturers are required to get certification with CPCB? As per provision 4(h) of PWM Rules “The manufacturers or seller of compostable plastic carrybags shall obtain a certificate from the Central Pollution Control Board before marketing or selling”

4. What is the procedure of Certification?

The procedure for application has been detailed in “Standard Operating Procedure (SOP) for Issuing Certificate to Manufacturers/Sellers of Compostable Plastic as per Plastic Waste Management (PWM) Rules, 2016) which is available on CPCB website

5. What is the procedure for registration on the website:

The applicant has to provide the following details related to the Authorized person filing the application as well as the unit for registration on the website ∙ Company Name

∙ Authorized Person’s - Name and Designation
∙ Company PAN Card No.
∙ Email address

6. What essential documents are to be submitted along with the applications?

i. The manufacturer/sellerof compostable plastic carry bags can apply to CPCB for the registration in Form-A (Manufacturer) ( Annexure II) and Form-B (Seller) (Annexure III), along with the prescribed documents. 
ii. Application along with digitally signed documents to be submitted by email on upc2.cpcb@gov.in.

7. Which tests have to be carried out for compostable plastics? 

As per Rule 4(h) of PWM Rules “Carry bags made from compostable plastics shall conform to the Indian Standard: IS 17088:2008 titled as Specifications for Compostable Plasticsas amended from time to time.”

Details are given in Annexure-IV of SOP

8. Which are CPCB recognized Government laboratory having adequate testing facilities?

Currently only Central Institute of Petrochemicals Engineering and Technology (CIPET) is the CPCB recognized government laboratory is having adequate testing facilities to conform to IS 17088:2008.

9. What submissions have to be made post issue of certificate to manufacturer or the seller?

∙ The Manufacturer/ seller manufacturer shall generate QR code based on the details (Name, plant address, CPCB certificate no. etc.) provided in the certificate issued by CPCB and QR code shall be provided on each of the carry bag manufactured at the certified unit. The “verifiable” details of the QR code shall be shared with the CPCB within one month of issue of this Certificate.

∙ The Manufacturer/ seller shall upload six-monthly report, giving details of manufacture and sale of Compostable plastics. Scanned copy of tax invoices

∙ The half yearly progress reports/QR code have to be uploaded on the portal.

10. If an industry is manufacturing compostable granules, whether the applicant is eligible for certification as manufacturer/seller of compostable plastics

As per Rule 4(h) the manufacturers or seller of compostable plastic carrybags shall obtain a certificate from the Central Pollution Control Board before marketing or selling.

Hence, Certificate from CPCB for manufacture of compostable raw material is not required in accordance with provision of PWM Rules.

11.What is the application fee for certification of manufacturer / seller of compostable plastic?

The application fee for certification of manufacturer / seller of compostable plastic is based on the manufacturing capacity of the plant as per the details given below:

As per SOP, the applicant has to respond to CPCB’s query and if no response is received from the applicant within thirty days of receipt of CPCB query, the application shall be considered as rejected/withdrawn. The application can be resubmitted along with the resubmission fee as per details given below:
