ESIC to Pay 70% Salary of 4.2 Cr Beneficiaries

If the media news is to be believed, Govt of India has made a wonderful decision in the aid of ESIC beneficiaries and employers. As per the news, Govt of India has declared that the ESIC will pay 70% salaries of the beneficiaries.

Sickness Benefit represents periodical cash payments made to an Insured Person during the period of certified sickness occurring in a benefit period when Insured Person requires medical treatment and attendance with abstention from work on medical grounds. Prescribed certificates are; Forms 8, 9,10,11 & ESIC-Med.13. Sickness benefit is 70% of the average daily wages and is payable for 91 days during 2 consecutive benefit periods.

In the normal course, ESIC provides health care benefits to Insured Persons having salaries up to Rs 21000/- through its designated hospitals. In case an Insured Person is not able to attend work due to illness, ESIC pays 70% of the salary for the period they are out of work.
ESIC has the free funds to the tune of Rs 60000 Cr and with the 4.2 crore Insured persons, there could be an outflow of Rs 35000/- Cr. This could be a major relief for both employers and Insured Persons. Most of the employers are aware, ESIC, since last month, have started collecting the details of bank accounts of Insured Persons.

Qualifying Conditions for availing Sickness Benefits.

  1. To become eligible for Sickness Benefit, an IP should have paid contribution for not less than 78 days during the corresponding contribution period.
  2. A person who has entered into insurable employment for the first time has to wait for nearly 9 months before becoming eligible for sickness benefit, because his corresponding benefit period starts only after that interval.
  3. Sickness Benefit is not payable for the first two days of a spell of sickness except in case of a spell commencing within 15 days of closure of earlier spell for which sickness benefit was last paid. This period of 2 days is called "waiting period". This provision should be clearly understood by IMOs/IMPs as actual experience shows that such of IPs who want to avail medical leave on flimsy grounds generally come for First Certificate/First & Final Certificate within 15 days of earlier spell, usually on unpaid holidays and/or on each weekly off etc, to avoid loss of benefit for 2 days due to fresh waiting period.

Rajiv Gandhi Shramik Kalyan Yojana : This scheme of Unemployment allowance was introduced w.e.f. 01-04-2005. An Insured Person who becomes unemployed after being insured three or more years, due to closure of factory/establishment, retrenchment or permanent invalidity are entitled to Unemployment Allowance equal to 50% of wage for a maximum period of up to Two Years.
Medical care for self and family from ESI Hospitals/Dispensaries during the period IP receives unemployment allowance.

Vocational Training provided for upgrading skills - Expenditure on fee/travelling allowance borne by ESIC.

Atal Bimit Vyakti Kalyan Yojana : This scheme is a welfare measure for employees covered under Section 2(9) of ESI Act, 1948, in the form of cash compensation upto 90 days, once in a lifetime, to be claimed after three months in one or more spells for being rendered unemployed, provided the employee should have completed two years of insurable employment and has contributed not less than seventy eight (78) days in each of the four consecutive contribution periods immediately preceding to the claim of the relief. The relief shall not exceed twenty five percent (25%) of the average earning per day.
