The draft Food Safety and Standards (Fortification of Foods) Amendment Regulations, 2019

The Food Safety and Standards Authority of India (FSSAI) on August 28, 2019, have published a draft Food Safety and Standards (Fortification of Foods) Amendment Regulations, 2019, vide Notification No. F. No. 1-116/Scientific Committee/Notif.28.6/2010-FSSAI, to further amend the FSS (Fortification of Foods) Regulations, 2018.
1. In Regulation 4(1) relating to “Compliance with Standards on Micronutrient Content in Fortified Foods”, the sub-regulation shall be substituted, namely:-
“Any manufacturer who fortifies any food shall ensure that the declared value of micronutrients on label of such fortified food shall fall within the levels (minimum-maximum) specified in Schedule-I during the declared shelf life of the products.”
2. After Regulations 7(3) relating to “Packaging and Labelling Requirements”, the following provision shall be inserted, namely:
“Provided that tolerance of +/- 10 percent of the declared value of micronutrients on the label may be allowed for the purposes of compliance and analysis at any point in time within declared shelf life of the product.”
All the persons likely to be affected thereby are requested for objections or suggestions within thirty days from the date on which the copies of the Official Gazette in which this notification is published are made available to the public. The objections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, Food and Drug Administration Bhawan, Kotla Road, New Delhi-110002, or may be sent at regulation@fssai.gov.in.

NOTIFICATION New Delhi, the 28th August, 2019

F. No. 1-116/Scientific Committee/Notif.28.6/2010-FSSAI.—The following draft of certain regulations further to amend the Food Safety and Standards (Fortification of Foods) Regulations, 2018, which the Food Safety and Standards Authority of India proposes to make, with the previous approval of the Central Government in exercise of powers conferred by clause (e) of sub-section (2) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006) is hereby published as required by the said sub-section (1) of section 92, for the information of persons likely to be affected thereby and notice us hereby given that the said draft regulations will be taken into consideration after expiry of a period of thirty days from the date on which the copies of the Official Gazette in which this notification is published are made available to the public; 
Objections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, Food and Drug Administration Bhawan, Kotla Road, New Dlehi-110002, or may be sent at regulation@fssai.gov.in: 

The objection or suggestion which may be received from any person with respect to said draft regulations, before the expiry of the period specified above, will be considered by the Food Authority.

Draft Regulations
1. Short title and commencement.- (1) These regulations may be called the Food Safety and Standards (Fortification of Foods) ......Amendment Regulations, 2019. 
 (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Food Safety and Standards (Fortification of Foods) Regulations, 2018 (herein after referred as said regulation)- 
(A) in regulation 4 relating to “Compliance with Standards on Micro-nutrient Content in Fortified Foods” for sub-regulation (1) the following shall be substituted, namely:- 
“Any manufacturer who fortifies any food shall ensure that the declared value of micro-nutrients on label of such fortified food shall fall within the levels (minimum-maximum) specified in Schedule-I during the declared shelf life of the products.”;   
(B) In regulations 7 relating to “Packaging and Labelling Requirements” after sub-regulation (3), the following provision shall be inserted, namely:- 
“Provided that tolerance of +/- 10 per cent of the declared value of micro-nutrients on the label may be allowed for the purposes of compliance and analysis at any point in time within declared shelf life of the product.
