Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation and Storage) Rules, 2019

The State Government of Bihar on September 17, 2019, has published the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation and Storage) Rules, 2019. It will extend to whole of Bihar.

However, as per these Rules:

No person shall undertake any mining operation in any area, except under and in accordance with the terms and conditions of a quarrying permit or, as the case may be a mining lease, granted under these rules.

There is restriction on the grant of quarrying permit or mining lease. No mining lease and quarry permit shall be granted for any minor minerals as the State Government may notify in this behalf.

Further it includes:

1. Appointment of Authorities and their establishments;
2. General restrictions on undertaking mining operation;
3. Procedure for grant of a mining lease except sand;
4. Settlement of sand;
5. Role of State owned mining corporation;
6. Procedure for grant of quarrying permit; 
7. Regulation and revenue collection from brick kiln;
8. Storage of minor or major minerals beyond lease hold area;
9. Electronic requirements;
10. Grant of transit pass or challan or E-challan for movement of minerals
11. Cancellation of minerals concession;
12. Mining revenue;
13. Offences and penalties;
14. Detection, investigation and trial of offences;
15. Appeals and Revision;
16. Enforcement and Exemptions.

It shall come into force on the day of its publication in the Official Gazette
