📜 What’s New in the Tamil Nadu BOCW Rules (2006)?

📌 Notification: G.O. Ms. No. 49, dated 27th May 2025

Under the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, the Tamil Nadu government has amended Rule 241(3).

✅ Amendment Summary:

The rule now includes a reference to:

“...or the Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979 (Central Act 30 of 1979)”.


⚖️ What This Means:

This change ensures that inter-state migrant workers working under BOCW-covered establishments will now be explicitly governed under both:

  • Contract Labour (Regulation and Abolition) Act, 1970

  • Inter-State Migrant Workmen Act, 1979

This strengthens the legal backing for rights, welfare, and protection of migrant workers in Tamil Nadu’s construction sector.


🏭 Key Amendment in Tamil Nadu Factories Rules (1950)

📌 Notification: G.O. Ms. No. 50, dated 27th May 2025

As per the powers under the Factories Act, 1948, the government has proposed a draft amendment to Rule 4(6) of the Tamil Nadu Factories Rules, 1950.

✅ Draft Amendment Addition:

A new proviso allows:

“...in case of fireworks factories, the maximum number of persons shall be fifteen percent in excess of the man limit specified in the licence granted under the Explosives Act, 1884 and the Explosives Rules, 2008.”

🎆 Why This Matters:

  • Recognizes seasonal or surge demands in the fireworks industry.

  • Provides legal flexibility for controlled workforce increase.

  • Aims to balance safety regulation compliance with industry needs.

However, objections/suggestions can be submitted within 45 days of the Gazette date.
