Maharashtra - Circular for Holiday or Two Hours Concession For Voters

Legislature of Maharashtra vide notification has proclaimed political race occasion ( Election Day) on 21 of October 2019 for all establishments situated in Maharashtra .

In pursuant to the Maharashtra Assembly Election, scheduled on 21st October 2019 and the enclosed circular for employers instructed to provide 
  • Paid holiday to all employees working in such establishment.
  • Seek permission from concerned district authority to provide only two to three hours of paid-leave to all employees for exercising their right to vote.

Government Circular:

Our country has embraced democracy and everyone registered with the age of 18 is expected to vote 100% in every election. In view of this matter, according to section 135-B of the People's Representation Act, 1951, full day paid leave is usually given to the voters to claim their voting rights on the day of election day, or in some places suitable concession are given in the work hours. However, in the last few elections, it has been found that the establishment does not offer holiday or concession. This is why many voters have to be deprived of their voting, which is extremely dangerous for democracy. 

2. According to the Election Commission of India, Assembly elections will be held in 288 Assembly area on 21st October 2019. In this election all voters should be given a paid holiday to win their voting rights. 

  1. Workers / officers / employees of voters in the electoral polling area should be given a leave to claim their voting rights on Election Day, even if they are working outside the field of election.
  2. This holiday will be applicable to all the establishments, factories, shops, etc. coming under the Industry, Energy and Labor Department (for example, establishment of private companies, all shops and other establishments, residential hotels, eating houses, other houses, theaters , businesses, industrial activities or other establishments as well as Information and technology companies, shopping centers, malls, retailers, etc.).
  3. In exceptional circumstances, if it is not possible to allow full day holiday to the workers, officers, employees, etc., in the voting area, workers can get a concession of two to three hours instead of holiday to claim the voting rights on Election Day. However, prior approval of the concerned municipal commissioner or collector will be necessary. In any case, the owners of the respective establishment must take vigilance to ensure that voters get minimum two to three hours concession for voting.
  4. As mentioned above, owners of the all establishments/ managements who comes under industries, energy and labour department should take precautions carefully & ensure to follow the above instructions properly. If there is a complaint about voters not getting the right holiday or concession for voting, appropriate action will be taken against them.

शासन परिपत्रक
1. आपल्या देशातील लोकशाही पध्दतीनुसार १८ वर्षावरील नोंदणी झालेल्या सर्व नागरिकांनी प्रत्येक निवडणुकीमध्ये १०० टक्के मतदान करणे अपेक्षित आहे. ही बाब लक्षात घेता लोकप्रतिनिधीत्व कायदा,१९५१ (भाग-२) मधील नियम १३५ (ब) नुसार मतदानाच्या दिवशी सर्वसाधारणपणे मतदारांना त्यांचा मतदानाचा हक्क बजावता यावा यासाठी भरपगारी सुट्टी देण्यात येते किंवा काही ठिकाणी कामाच्या तासात योग्य ती सवलत देण्यात येते. मात्र गेल्या काही निवडणुकांमध्ये असे दिसून आले आहे की, संस्था/ आस्थापना इ. भरपगारी सुट्टी किंवा सवलत देत नाहीत. यामुळे अनेक मतदारांना त्यांच्या मतदानापासून वंचित रहावे लागते, जे लोकशाहीसाठी अत्यंत घातक आहे. 
२. भारत निवडणूक आयोगाने निर्गमित केलेल्या आदेशाप्रमाणे महाराष्ट्रातील २८८ विधानसभा क्षेत्रांमध्ये दिनांक २१ ऑक्टोबर, २०१९ रोजी निवडणूक घेतली जाणार आहे. या निवडणुकीमध्ये सर्व मतदारांना त्यांचा मतदानाचा हक्क योग्यरितीने बजावता यावा यासाठी खालील प्रमाणे आदेश देण्यात येत आहेत:
  1. निवडणूक होणाऱ्या मतदान क्षेत्रात मतदार असलेले कामगार/अधिकारी/कर्मचारी यांना मग ते कामानिमित्त निवडणूक होणाऱ्या क्षेत्राबाहेर कार्यरत असले तरीही त्यांना निवडणुकीच्या दिवशी मतदानाचा हक्क बजावण्यासाठी भरपगारी सुट्टी देण्यात यावी. 
  2. सदर सुट्टी उद्योग, ऊर्जा व कामगार विभागांतर्गत येणाऱ्या सर्व आस्थापना, कारखाने,दुकाने इत्यादींना लागू राहिल(उदा.खाजगी कंपन्या या मधील आस्थापना, सर्व दुकाने व इतर आस्थापना, निवासी हॉटेल, खाद्यगृहे, अन्य गृहे, नाटयगृहे, व्यापार,औद्योगिक उपक्रम किंवा इतर आस्थापना तसेच माहिती व तंत्रज्ञान कंपन्या, शॉपिंग सेंटर, मॉल्स, रिटेलर्स इ.
  3. अपवादात्मक परिस्थितीत कामगार, अधिकारी, कर्मचारी इत्यादींना पूर्ण दिवस सुट्टी देणे शक्य नसेल तर, मतदान क्षेत्रातील कामगारांना मतदानाचा हक्क बजावण्यासाठी सुट्टी ऐवजी केवळ दोन ते तीन तासांची सवलत देता येईल. मात्र त्याबाबत त्यांनी संबंधित जिल्हाधिकारी तथा जिल्हा निवडणूक अधिकारी यांची पूर्व परवानगी घेणे आवश्यक राहिल. कोणत्याही परिस्थितीत मतदारांना मतदानासाठी किमान दोन ते तीन तासांची भरपगारी सवलत मिळेल याची दक्षता संबंधित आस्थापना मालकांनी घेणे आवश्यक राहिल.
  4. वर नमूद केल्याप्रमाणे, उद्योग, उर्जा व कामगार विभागांतर्गत येणा all्या सर्व आस्थापना / व्यवस्थापन मालकांनी काळजीपूर्वक खबरदारी घ्यावी व वरील सूचनांचे योग्य पालन करण्याचे सुनिश्चित केले पाहिजे. मतदारांना योग्य सुट्टी किंवा मतदानासाठी सवलत मिळत नसल्याची तक्रार असल्यास त्यांच्याविरूद्ध योग्य कारवाई केली जाईल. 
  5. भारतीय निवडणूक आयोगाच्या ईसीआय / पीएन / / 83 / २०१ 21 / दिनांक २१ सप्टेंबर २०१ 2019 नुसार परिपत्रक प्रकाशित केले आहे. www.maharashtra.gov.in या संकेतस्थळावर हे परिपत्रक उपलब्ध करुन देण्यात आले आहे आणि कोड 201909251517350010 आहे. हे परिपत्रक डिजिटल स्वाक्षरीद्वारे डिजिटल केले जात आहे
