Many incidents may occur privately. There may be no eyewitness. There may instead be statements, emails, messages, electronic records, surrounding circumstances and subsequent conduct.

The Deskbook emphasizes that the Internal Committee should evaluate the totality of the evidence and apply the principle of preponderance of probabilities, rather than importing the criminal-law standard of proof into a POSH inquiry.

It also identifies factors such as:

  • consistency of statements;

  • probability of the events described;

  • surrounding circumstances;

  • conduct before, during and after the incident;

  • contemporaneous documents and electronic records; and

  • corroborative evidence where available.

A POSH inquiry does not begin merely when the first question is asked.

The Deskbook provides a practical protocol for the commencement of proceedings, including preparation of the inquiry room, verification of documents, introduction of Committee Members, conflict-of-interest declarations, identity verification and confirmation that the parties have received the relevant documents.

It also emphasizes that the Committee should not begin with a presumption that the complaint is either true or false.

The inquiry must begin with an open mind.

That simple principle can have a profound impact on the credibility of the entire proceeding.


📑 A Finding Is Not Enough — Reasons Matter

One of the most important messages of the Deskbook is that an Inquiry Report should not simply state:

Complaint proved.

or

Complaint not proved.

The Committee must demonstrate how it arrived at the conclusion.

A reasoned finding should explain the allegation, defence, evidence, appreciation of evidence, finding and reasons supporting that finding.

This is where the quality of an Internal Committee becomes visible.

  • Evidence speaks through analysis.
